Bendigo pool builder fined

A Bendigo pool and spa building company has been fined $15,000 and forced to compensate two former customers after being found guilty of taking payment without supplying goods, the Bendigo Advertiser has reported.

LKS Lifestyle Solutions’ director, Lauren Smith, was prosecuted by Consumer Affairs Victoria after numerous complaints were made against the company. Smith was ordered to compensate at least two former clients after they launched proceedings in the Victorian Civil and Administrative Tribunal.

Appearing at Bendigo Magistrates’ Court, Smith was found to have entered into a contract for a pool worth more than $65,000 without having a director that was a registered builder. The company also failed to provide the client with a copy of the building contract.

Smith was convicted and fined $5000; the business was fined $10,000. In 2015, the business was ordered to repay a former customer a total of $16,446 for a pool that was purchased in 2014 but never installed.

A Consumer Affairs Victoria spokesperson said that consumers should take action early to prevent the dispute from escalating and to always ensure they have a written contract for building works, regardless of size or price.
