Federal Court Rules to Minimise Confusion

Friday, 22 February, 2013

Following a Federal Court of Australia hearing in late January, the Swimming Pool & Spa Association of NSW Ltd will now cease using SPASA Australia.

The applicants, SPASA Queensland, SPASA South Australia, SPASA Victoria and SPASA Western Australia, argue that the existing national body, the Swimming Pool & Spa Association of Australia Ltd, referred to as SPASA Australia, would be confused by consumers as well as Members if the announced NSW trading names were allowed to be used.

The proceedings were adjourned to a directions hearing on 20 February 2013. Results of the hearing can be found at www.poolandspareview.com.au
